Processing of your personal information (meaning, any information which may potentially allow your identification with reasonable means; hereinafter "Personal Information") is necessary for the performance of our contractual obligations towards you and providing you with our services, to protect our legitimate interests and for compliance with legal and financial regulatory obligations to which we are subject.

WHAT KIND INFORMATION CAN WE COLLECT?

When you use our website we can collect your Personal Information such as:

Your contact information required when you want to connect with us. In this case you have to fill in the proper fields with your name, E-mail (both are required) and optionally one of the next messenger contacts - WhatsApp, Telegram, Skype or Phone.

If you decided to become our client or partner you have to present us the following onboarding documents:

  • Certificate of Incorporation;
  • Certificate of good standing issued within the last 6 months;
  • Shareholders registry issued within the last 6 months and signed by the directors;
  • Latest Version of Memorandum and Articles of Association;
  • Organization chart showing the structure of the company dated and signed by the directors;
  • Director’s copy of ID and proof of address issued within the last 6 months;
  • Director’s source of wealth declaration (examples: employment Income, property sale, sale of shares or other investment, loan, company sale, company profits / dividends, inheritance, etc.);
  • UBO’s copy of ID and proof of address issued within the last 6 months;
  • UBO’s source of wealth declaration (examples: employment Income, property sale, sale of shares or other investment, loan, company sale, company profits / dividends, inheritance, etc.);
  • Bank statement showing ownership by the company or audited accounts (Optionally);
  • Latest audited financial statements (Optionally);
  • Bank Reference letter in the name of the Company (Optionally);
  • Filled and fully signed Application Form.

* Please, keep in mind that in some cases we may require additional details and documents for verification and KYC/Due Diligence procedure during the Onboarding.

Our system also tracks and collects all the information, which we receive when you surf on our website, namely your access date & time, device identification, operating system, IP address, browser type and version. We can obtain above mentioned data directly or using third party services.

Be noticed that Finectum does not collect any information you can be identified with without your permission.

We may also perform further background checks on you and request any relevant documentation from you for any reason related to your use of the Services and/or as supporting evidence for any information, you provide.You acknowledge that in order to conduct verification process and/or background checks, we may perform inquiries, directly or indirectly through third party service providers in the attempt to prevent misidentification, fraud, suspicious activity, money laundering or any other forbidden activity, and may take actions with respect to the outcome of such inquiries, as we deem necessary. You hereby provide us with your authorization for such inquiries, including with respect to a query of your account information.

HOW DO WE USE THE INFORMATION WE COLLECT?

SECURITY

Finectum implemented security measures to comply with accepted international security standards. All transactions made via our Crypto Payment Gateway Service are carried out in the private blockchain, developed on the basis of JPMorgan Chase platform. The high security level is confirmed by the implementation of our Crypto Payment Gateway into the World’s 1st Security Audited Software for cryptocurrency exchanges.

Our platform also uses SSL or TLS encryption for security reasons and for the protection of confidential content transmission when you send us requests. In your web browser’s address bar you can find an encrypted connection when “http://” changes to “https://” and the lock icon is displayed there. You can be sure that there will not be your Personal Data leaking to the third parties if SSL or TLS is enabled.

DATA STORING AND PROCESSING

  • All the documents and Text Data provided by the Customers to Finectum during the Registration and KYC/DD are stored encrypted;
  • Finectum keeps records about data processing, including data categories, the group of data subjects, the purpose of the processing and the data recipients;

  • At the time that the General Data Protection Regulation became applicable in the third countries, which ensure an adequate level of protection, data transfer to these countries is expressly permitted in cases when the information is solicited by Banks or competent Authorities.

RETENTION

We will retain your Personal Information for as long as necessary to provide our services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time.
